ProcLog Terms of Use

These Terms of Use ("Terms") govern access to and use of the ProcLog mobile application and any associated support website (collectively, the "Services"), published by C.A.R.E. By downloading, accessing, or using ProcLog, you agree to these Terms.

1. Eligibility and Intended Use

ProcLog is intended for use by individual medical providers, clinicians, trainees, and other healthcare professionals for their own personal professional documentation and recordkeeping purposes. ProcLog is not intended to serve as an electronic health record, hospital credentialing platform, enterprise workforce system, or legal repository of official clinical documentation, and is not provided on behalf of any hospital, clinic, health system, payer, or other covered entity.

You are responsible for ensuring that your use of ProcLog complies with all applicable laws, your employer's policies, facility rules, licensing standards, and professional obligations — including any restrictions your institution places on recording, storing, or transmitting patient-related information on personal devices or personal applications.

2. No Medical, Legal, or Credentialing Advice

ProcLog is a documentation and organizational tool only. It does not provide medical advice, legal advice, privileging decisions, credentialing determinations, or professional certification. Procedure codes shown in the App (ICD-10-PCS, CPT) are provided for reference and organizational purposes only and may not be current, complete, or applicable to every context — verify all codes against official current code sets before relying on them for credentialing, billing, or any official purpose. Any reports, summaries, or exports generated by the App are for your convenience and may require independent verification before submission to a third party.

3. User Content and Responsibility

You are solely responsible for the information you enter into ProcLog, including procedure logs, notes, identifiers, and exported records. You represent that you have the right to enter and maintain any information you submit to the App, and that doing so does not violate any privacy, confidentiality, employment, or professional obligation you hold. You should avoid entering unnecessary sensitive or identifying patient information. Any export or sharing of your data is initiated and controlled entirely by you — ProcLog has no visibility into, and no role in, what you do with an exported file.

4. No Account System; Device Security

ProcLog does not use a login, account, username, or password. Your profile and log data are tied to your device (and, if enabled, your personal cloud account — iCloud on iOS or Google Drive on Android) rather than to any credential we issue or manage. You are responsible for the physical and digital security of your device, including using a device passcode and, if desired, ProcLog's optional biometric App Lock (Face ID/Touch ID on iOS, fingerprint or face unlock on Android), to prevent unauthorized access to your logs.

5. Free Usage and Subscription (ProcLog Pro)

ProcLog lets you log your first 5 procedures at no cost. Logging additional procedures requires an active ProcLog Pro subscription. Viewing, editing, and exporting procedures you've already logged remain available at no cost regardless of subscription status.

ProcLog Pro is offered as an auto-renewing subscription with monthly and annual options, and may include a free trial. Pricing, currency, trial length, and exact terms are displayed in the App and in your app store account (Apple ID on iOS, Google Account on Android) before you confirm a purchase. The store that applies to you is the one you installed ProcLog from. Key terms:

• New subscribers may be offered a 7-day free trial. If you do not cancel at least 24 hours before the trial ends, it automatically converts to a paid subscription at the price shown, charged to your app store account. You can cancel during the trial at no charge.
• Payment is charged to your app store account — your Apple ID on iOS, or your Google Play account on Android — at confirmation of purchase (or, where a free trial applies, when the trial converts).
• Subscriptions automatically renew for the same duration and at the then-current price unless canceled at least 24 hours before the end of the current period.
• Your app store account will be charged for renewal within 24 hours prior to the end of the current period.
• You can manage or cancel your subscription anytime: on iOS in device Settings > Apple ID > Subscriptions, or on Android in the Google Play Store under Payments & subscriptions. Canceling does not refund the current billing period; access continues until the end of the paid period.
• All billing, refunds, and subscription management are handled directly by Apple (under the App Store's Media Services Terms and Conditions) or by Google (under Google Play's Terms of Service), depending on where you purchased — C.A.R.E. does not process payments, does not receive your payment card details, and cannot issue refunds directly.

If you previously purchased ProcLog Pro on another device signed into the same Apple ID or Google Account, use "Restore Purchases" in the App to reactivate access without paying again. Purchases are not transferable between platforms: a subscription bought on iOS cannot be restored on Android, or vice versa, because each store manages its own billing independently.

6. Acceptable Use

You agree not to:

• use ProcLog for unlawful, fraudulent, or deceptive purposes;
• interfere with or attempt to disrupt the Services;
• attempt to gain unauthorized access to the Services or any related systems;
• reverse engineer, decompile, scrape, or misuse non-public portions of the App, except to the extent such restriction is prohibited by applicable law;
• use ProcLog in a manner that infringes the rights of others or violates applicable privacy, confidentiality, or institutional policy obligations.

7. Intellectual Property

The Services — including software, design, trademarks, logos, text, graphics, and the curated procedure catalog compilation — are owned by C.A.R.E. or its licensors and are protected by applicable intellectual property laws. Subject to these Terms, you receive a limited, non-exclusive, non-transferable, revocable license to use the App for your own personal professional purposes. Underlying public code sets (such as ICD-10-PCS and CPT) remain the property of their respective standard-setting organizations.

8. Service Availability and Changes

We may modify, suspend, or discontinue any part of the Services at any time, with or without notice, and features (including export, cloud sync, or notification functionality) may change between versions.

9. Disclaimer of Warranties

The Services are provided "as is" and "as available," to the maximum extent permitted by law. C.A.R.E. disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. C.A.R.E. does not warrant that the Services will be uninterrupted, error-free, secure, or suitable for any particular credentialing, employment, or legal purpose, and does not warrant that any employer, institution, or credentialing body will accept records generated by ProcLog as sufficient or official.

10. Limitation of Liability

To the maximum extent permitted by law, C.A.R.E. and its owners, officers, employees, contractors, and affiliates will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of data, professional opportunity, revenue, or goodwill, arising from or related to your use of the Services. Because ProcLog stores your data on your own device and your own cloud account, you are strongly encouraged to maintain independent backups and records as required by your institution.

11. Indemnification

You agree to indemnify and hold harmless C.A.R.E. and its affiliates, personnel, and service providers from claims, liabilities, damages, and expenses arising out of your content, your conduct, your misuse of the Services, or your violation of these Terms or applicable law.

12. Termination

We may suspend or terminate your access to the Services if you violate these Terms, create risk for C.A.R.E. or others, or if continued operation of the Services is no longer feasible. Because ProcLog has no account system, "termination" generally means the App ceasing to be available or supported, not the suspension of an account.

13. Governing Law

These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law rules, except to the extent superseded by applicable consumer protection law.

14. Changes to These Terms

We may update these Terms from time to time. Continued use of the Services after updated Terms become effective constitutes acceptance of the revised Terms.
